Terms of Sales
These general conditions of sale are applicable to the reservation of stays in guest rooms or to the rental of the house Les Yeux Bleus located 20b impasse des Roussières, 85330 Noirmoutier en l'Île, France. They constitute the reservation contract between the owner Guy Le Roy and the guest of a guest room stay.
Article 1 - Duration of stay : the customer rents one or more rooms for a fixed period and may not under any circumstances invoke any right to remain in the premises.
Article 2 - Prices : the prices indicated on this website are the only contractual prices. They include all taxes (the owner is not subject to VAT, article 293 B of the CGI).
Article 3 - Confirmation of a reservation : the reservation is made by email or by phone directly with the owner or through Booking. The reservation is considered firm only after receipt of a deposit cashed upon receipt and deductible from the invoice when paying the balance on arrival. The deposit must be paid no later than 5 working days from the date of the reservation request. The amount of the deposit is:
• In the case of a direct reservation with the owners: at 30% of the total price of the stay with a minimum corresponding to the price of one night per room reserved.
• In the case of a reservation via the Booking site: 30% of the total price of the stay.
Payment of the deposit can be made:
• by check payable to Guy Le Roy,
• in cash or by bank transfer.
Payment of the deposit implies acceptance of these general conditions of sale. Upon receipt of the deposit, you will be sent an email of good receipt with the details of the service reserved, having the value of a contract. If the reservation is made by telephone, we undertake to confirm receipt of the deposit by telephone or by text message. If the customer wishes, a reservation contract can be sent to him by mail.
Article 4 - Cancellation by the customer : any cancellation must be notified by post or email addressed to the owner.
• If the cancellation occurs more than 30 days before the start of the stay, the deposit is returned to the customer.
• If the cancellation occurs less than 30 days before the start of the stay, the deposit remains with the owner who reserves the right to claim the balance of the price of the accommodation.
• If the client does not show up before 7 p.m. on the day scheduled for the start of the stay, the owner reserves the right to use his guest rooms. The deposit remains with the owner who reserves the right to claim the balance of the price of the accommodation.
• If the client does not respect the maximum arrival time, the owner reserves the right to refuse to welcome clients. The deposit remains with the owner who reserves the right to claim the balance of the price of the accommodation.
• In the event of a shortened stay, the price corresponding to the cost of accommodation remains fully acquired by the owner.
Article 5 - Cancellation by the owner : when before the start of the stay the owner cancels the stay, for reasons beyond his control, he must inform the customer as quickly as possible by telephone or email. This will be refunded immediately of the sums paid.
Article 6 - Time of arrival : the customer must present himself on the day specified for the reservation and at the times mentioned below. The rooms are available from 4 p.m. Please notify in case of arrival after 7 p.m.
We no longer accept arrivals after 9 p.m. between October 1 and April 30, after 10 p.m. between May 1 and September 30 and we reserve the right to no longer welcome customers after these hours. This refusal can in no case be considered as a modification or a breach of the contract at the initiative of the owner so that no refund can be considered.
Article 7 - Time of departure : the rooms must be vacated by 10 am. After 12 noon, you will be charged an additional night.
Article 8 - Payment of the balance for the accommodation : the balance for the stay will be payable on arrival. Payment of the balance can be made:
• In cash or by bank transfer,
• By check payable to Guy Le Roy.
Consumptions and additional services not provided for will be paid at the end of the stay.
Article 9 - Tourist tax : the tourist tax is a local tax. It is collected in addition to the price of the night by the owners on behalf of the Municipality and it is then transferred to the Public Treasury. The tax is now collected throughout the year , its amount remains at 0.60 € per person per day from 01.01.2019.
Article 10 - Change of rooms : without the customer being able to claim any compensation, the owner reserves the right to change the room initially reserved by the customer with a room of the same or greater capacity. In such a case, the cost of the reservation remains unchanged.
Article 11 - Capacity : the reservation is made for a specific number of people. If on the day of arrival the number of occupants proves to be greater, the owner is able to refuse the additional people. This refusal can in no case be considered as a modification or a termination of the contract at the initiative of the owner so that in the event of departure of a number of people higher than those refused no refund can be considered.
Article 12 - Breakfast : it is served on arrival from 8:30 am to 10:00 am in the dining room or in the outdoor courtyard if the weather permits.
Article 13 - Pets : these are not accepted. If on the day of arrival, the customer shows up accompanied by one or more animals, the refusal to accept the animals and their owners by the owner of the guest rooms cannot be assimilated to a modification or breach of the contract at the owner's initiative. So that in the event of the customer's departure, no refund can be considered.
Article 14 - Knowing how to live and behave, using the premises : respect for a certain savoir vivre is required of all guests to guarantee the tranquility of the place and the comfort of its guests.
In addition, "Les Yeux Bleus" is a completely non-smoking area with the exception of the outdoor courtyard. It is also requested not to eat in the rooms.
The customer undertakes to respect the instructions for good living appearing in these general conditions of sale. The customer undertakes to return the rooms in perfect condition at the end of the stay and to declare and financially assume any possible degradation for which he could be responsible. Children are the sole responsibility of their parents.
Article 15 - Data processing and freedoms : in accordance with the law of January 6, 1978, you have the right to access and rectify data concerning you. The owner undertakes not to transmit the information you have communicated to other companies or organizations.
These conditions of sale are subject to change at any time without notice. The acceptance and respect of these general conditions of sale are deemed to have been acquired upon payment of the deposit.
